ABCR Code of Ethics

The ethical obligations of all ABCR-certified professionals. Adherence to this Code is a condition of certification and recertification.

Preamble

The American Board of Certified Recruiters (ABCR) exists to advance the professionalism, competency, and ethical conduct of those who practice recruiting. The ABCR Code of Ethics sets forth the standards of conduct to which all certified professionals are held as a condition of earning and maintaining the CR or CRA designation.

This Code reflects the values that define an ethical recruiting practitioner: honesty in all representations, respect for all persons, commitment to legal compliance, and dedication to the welfare of candidates, clients, and the broader profession.

All individuals who hold the CR or CRA designation agree, as a condition of certification, to abide by this Code and to submit to ABCR’s enforcement procedures in the event of a complaint. Violations of this Code may result in disciplinary action up to and including permanent revocation of certification with public notice.

Note: This Code establishes ethical obligations for certified individuals. It does not create legally enforceable duties beyond those imposed by applicable law, and it does not constitute legal advice. Certificants are responsible for complying with all applicable federal, state, and local laws governing their recruiting practice.

Article I

Honesty and Transparency

  • I.1

    Certified Recruiters shall not engage in deception, misrepresentation, or material omission in any professional communication or transaction.

  • I.2

    Certified Recruiters shall accurately represent candidate qualifications to clients and job details to candidates at all times.

  • I.3

    Certified Recruiters shall disclose material facts to all parties even when doing so is against their own financial interest.

  • I.4

    Certified Recruiters shall not misrepresent their own credentials, certifications, or professional standing.

Article II

Fairness and Non-Discrimination

  • II.1

    Certified Recruiters shall evaluate candidates based on qualifications and legitimate job requirements only.

  • II.2

    Certified Recruiters shall not solicit, accept, or act on discriminatory instructions from clients or employers.

  • II.3

    When job criteria appear to serve as a proxy for discrimination, Certified Recruiters shall raise the concern with the client and document the interaction. If the criteria are clearly discriminatory, the recruiter shall refuse the assignment.

  • II.4

    Certified Recruiters shall provide the same quality of service to all clients and candidates regardless of the fee value of the engagement.

Article III

Confidentiality

  • III.1

    Candidate information -- including compensation, job search status, personal details, and health information -- is strictly confidential and shall not be disclosed without the candidate’s explicit consent.

  • III.2

    Client information -- including hiring strategies, compensation structures, and personnel decisions -- is confidential and shall be protected accordingly.

  • III.3

    Certified Recruiters shall not use confidential information obtained through professional practice for personal benefit or advantage.

  • III.4

    Certified Recruiters shall comply with all applicable data privacy laws and regulations governing the collection, storage, and use of personal information.

Article IV

Conflicts of Interest

  • IV.1

    Certified Recruiters shall disclose all relationships, financial interests, and circumstances that could influence or appear to influence their professional judgment.

  • IV.2

    Certified Recruiters shall not make undisclosed placements at organizations in which they hold a financial interest.

  • IV.3

    Certified Recruiters shall not engage in dual representation of both client and candidate in the same transaction without the informed consent of all parties.

  • IV.4

    Certified Recruiters shall not accept gifts, payments, or other consideration from candidates in connection with placement services. No kickbacks or undisclosed compensation arrangements are permitted.

Article V

Competence

  • V.1

    Certified Recruiters shall maintain all continuing education requirements established by ABCR as a condition of certification.

  • V.2

    Certified Recruiters shall stay current on applicable employment law, industry trends, and evolving best practices in recruiting.

  • V.3

    Certified Recruiters shall not accept assignments that fall beyond the scope of their competence without appropriate support or referral.

  • V.4

    Certified Recruiters shall be honest about the limitations of their knowledge, experience, and professional capabilities.

Article VI

Professional Conduct

  • VI.1

    Certified Recruiters shall treat all candidates, clients, colleagues, and other parties with dignity and respect.

  • VI.2

    Certified Recruiters shall respond to candidates in a timely manner. Ghosting candidates -- failing to provide updates or closure -- is an explicit violation of this Code.

  • VI.3

    Certified Recruiters shall not make disparaging statements about other recruiters, firms, or industry professionals.

  • VI.4

    Certified Recruiters shall honor all commitments made to candidates and clients and shall not engage in exploitative fee practices.

Article VII

Compliance with Law

  • VII.1

    Certified Recruiters shall know and comply with Title VII, ADA, ADEA, FCRA, FLSA, and applicable state and local wage, hour, and employment laws.

  • VII.2

    Certified Recruiters shall follow proper I-9 verification and background check procedures as required by law.

  • VII.3

    Certified Recruiters shall not facilitate or assist any party in the evasion of applicable employment laws or regulations.

Article VIII

Reporting Violations

  • VIII.1

    Certified Recruiters who have credible knowledge of a violation of this Code by another certificant shall report the matter to the ABCR Ethics Committee.

  • VIII.2

    Certified Recruiters shall not retaliate against any person who makes a good-faith report of a suspected Code violation.

  • VIII.3

    Certified Recruiters shall cooperate fully with ABCR investigations into alleged Code violations when called upon to do so.

Accountability

Enforcement & Accountability

ABCR maintains a formal process for receiving and investigating complaints of ethical misconduct by certified professionals. This process is designed to ensure due process, fairness, and consistency.

Complaint Submission

Any person may submit a complaint alleging that a certified professional has violated the ABCR Code of Ethics. Complaints must be submitted in writing and include sufficient detail to enable investigation.

Investigation

ABCR will review all complaints and conduct a reasonable investigation. The subject of a complaint will be notified and given the opportunity to respond.

Adjudication

An independent ethics panel reviews investigated complaints and makes findings of fact and recommendations for action. Panel members have no conflicts of interest with the parties involved.

Appeals

Certificants subject to disciplinary action have the right to appeal the decision through ABCR’s published appeals process. The appeals process provides an additional level of review.

Sanctions

Disciplinary Actions

Upon a finding that a certified professional has violated the Code of Ethics, ABCR may impose one or more of the following escalating sanctions, commensurate with the severity of the violation:

1. Formal Written Warning

A formal written notice to the certificant that their conduct violated the Code of Ethics.

2. Required Remedial Education

Mandatory completion of specified ethics or professional development coursework as a condition of continued certification.

3. Probation with Conditions

The certificant retains their designation but is placed on probation with specific conditions that must be met within a defined timeframe.

4. Suspension for Defined Period

Temporary removal of the right to use the CR or CRA designation for a specified duration.

5. Permanent Revocation with Public Notice

Permanent removal of the certification with public notice. The certificant loses the right to use the CR or CRA designation.

Detailed ethics policies, procedures, and forms will be published in the ABCR Ethics Handbook prior to the first certification cycle.

Professional Conduct

Standards of Professional Conduct

Beyond the Code of Ethics, ABCR expects all certified professionals to uphold the following standards of professional conduct in their day-to-day practice.

Represent the CR or CRA designation accurately and only while certification is active
Promptly notify ABCR of any criminal conviction or professional sanction that may bear on certification status
Do not use the designation in a way that implies ABCR endorsement of specific products or services
Cooperate with ABCR audits of continuing education compliance
Promptly respond to communications from ABCR related to certification status or ethics inquiries
Use the correct post-nominal letters (CR or CRA) and do not use abbreviations not authorized by ABCR
